NOTICE: The Office of the Chief Financial Officer (OCFO) has issued the 2008 OJP Financial Guide (Guide). The Guide is now available at http://www.ojp.usdoj.gov/financialguide/index.htm. The rules and guidelines in the 2008 Guide are applicable to all open awards, effective upon publication. Supreme Court overturns L.A. murder conviction Justices' 6-3 ruling in a domestic violence case makes it more difficult for prosecutors to use victims' previous statements to police. By David G. Savage, Los Angeles Times Staff Writer June 26, 2008 http://www.latimes.com/news/nationworld/washingtondc/la-na-giles26-2008jun26,0,4503785.story WASHINGTON -- -- The Supreme Court dealt a setback to prosecutors in domestic violence cases Wednesday, ruling that a slain woman's earlier reports to the police of her boyfriend's threats may not be used against him at his trial unless it can be shown he killed her in order to silence her as a witness. Often, when spouses or partners are found dead at home, the strongest evidence to show the victim was murdered comes from their earlier statements to police. But the high court, led by Justice Antonin Scalia, said the use of such statements at trial violates the defendant's right to "confront" the accuser. The 6-3 decision overturned the murder conviction of a Los Angeles man who shot and killed his girlfriend. Dwayne Giles, the convicted killer, admitted he shot Brenda Avie six times when she came to his house in South Los Angeles on Sept. 29, 2002, but he said he acted in self-defense. Read More |

The national research of David Hirschel and Eve Buzawa on dual arrest practices, "Explaining the Prevalence, Context and Consequences of Dual arrest in Intimate Partner Cases" will be discussed during the July 10, 2008 audioconference. Captain Pete Helein of the Appleton Police Department and Wanda Lucibello, Chief, Special Victims Unit of the Brooklyn DA's Office will be the practitioners reflecting on the research. April 24, 2008 Dear OJP and OVW Grantees: We are pleased to announce that on April 23, 2008, the Office of Justice Programs (OJP) released a new module in the existing Grants Management System (GMS) On-line Training Tool (on-line training tool). This latest release will assist you with creating and submitting your Financial Status Reports (SF-269) in GMS. These reports are due quarterly. As a reminder, the last date to submit the current Financial Status Report is May 14. As you know, if you do not submit a timely financial status report in GMS, your funds will be frozen until such time as the report is submitted. As a reminder, the on-ling training tool includes the following sections: * GMS overview: This chapter provides you with an overview of GMS. Topics include logging into GMS and responding to change requests. * Grant Adjustment Notices (GANs): OJP requires grantees to receive prior approval before making various changes to the terms and conditions of the grant award. The on-line training tool defines the pre-approval requirements as well as walks the user through the steps needed to create, save and submit a GAN. * Progress Reporting: OJP requires grantees to submit progress reports (quarterly, semi-annual or annual). This section leads you through the creation and submission of your mandatory progress reports. * Closeouts: OJP requires grantees to submit a closeout package 90 days after the end date of the grant. This section leads you through the process of creating a closeout package at the end of your program. The training module can be accessed by going to http://www.ojp.usdoj.gov/gmscbt. In order to access the on-line training tool, your computer must have a connection to the internet, an internet browser (Internet Explorer is the preferred/supported browser), and an Adobe Flash Player (at least version 8) installed. (http://www.adobe.com/support/flashplayer/downloads.html) If you do not have this version of the Flash player already installed, you will want to check with your organization's Information Technology department to find out the policies for the installation of this software. If you have trouble viewing the on-line training materials using your internet connection, please contact your OJP or OVW program manager to have a CD version mailed to you.
